Parties to Malign Foreign Talent Recruitment Programs – Individuals who are a current party to a Malign Foreign Talent Recruitment Program are not eligible to serve as a senior/key person on an NSF proposal or on any NSF award made after May 20, 2024. See PAPPG Chapter II.D.1.e for additional information on required certifications associated with Malign Foreign Talent Recruitment Programs.
CH II.B.1, NSF Disclosure Requirements: Pre-Award Disclosures
As part of the proposal preparation and submission process, all individuals designated as a senior/key person on a proposal are required to submit information to assist reviewers and program staff in making informed recommendations and funding decisions. These disclosures are provided in the following proposal sections:
- Biographical Sketch; (see Chapter II.D.2.h(i));
- Current and Pending (Other) Support (see Chapter II.D.2.h(ii); and
- Collaborators and Other Affiliations (see Chapter II.D.2.h(iii)).
It is vital that submission of such disclosure information be taken seriously. The Biographical Sketch and Current and Pending (Other) Support documents require the individual to certify prior to proposal submission that the information provided is accurate, current, and complete, and that the individual is not a party to a malign foreign talent recruitment program (see Chapters I.E.2.(b) and II.D.1.e for additional information.) NSF will require all senior/key personnel on potential awards to submit updated Current and Pending (Other) Support information prior to making a funding recommendation.
CH II.D.1.d(ix), Certification Regarding Malign Foreign Talent Recruitment Programs
In accordance with Section 10632 of the CHIPS and Science Act of 2022 (42 U.S.C. § 19232), the AOR must certify that all individuals identified as senior/key personnel have been made aware of and have complied with their responsibility under that section to certify that the individual is not a party to a malign foreign talent recruitment program.
CH II.D.1.e(ii), Malign Foreign Talent Recruitment Programs
Pursuant to Section 10632 (42 U.S.C. § 19232), each identified as senior/key person must certify prior to proposal submission that they are not a party to a malign foreign talent recruitment program and annually thereafter for the duration of the award.
CH II.D.2.h(i), Biographical Sketch(es) – Senior/Key Personnel
Consistent with NSPM-33, individuals are required to disclose contracts associated with participation in programs sponsored by foreign governments, instrumentalities, or entities, including foreign government sponsored talent recruitment programs. Further, if an individual receives direct or indirect support that is funded by a foreign government-sponsored talent recruitment program, even where the support is provided through an intermediary and does not require membership in the foreign government-sponsored talent recruitment program, that support must be disclosed. Individuals must also report other foreign government-sponsored or affiliated activities. In accordance with 42 U.S.C. § 19232, individuals are prohibited from being a party in a malign foreign talent recruitment program.
Certification Requirement
Each senior/key person is required to complete the following certifications regarding the information provided in their Biographical Sketch:
I certify that the information provided is current, accurate, and complete. This includes but is not limited to information related to domestic and foreign appointments and positions. I also certify that, at the time of submission, I am not a party in a malign foreign talent recruitment program.
Misrepresentations and/or omissions may be subject to prosecution and liability pursuant to, but not limited to, 18 U.S.C. §§ 287, 1001, 1031 and 31 U.S.C. §§ 3729-3733 and 3802.
